Terms and Conditions
These Terms and Conditions ("Terms") govern the photography services provided by Saywell Photography ("we," "us," or "our"). By booking our services, you agree to these Terms. Please read them carefully.
1. Services Provided
1.1. We offer professional photography services,
1.2. Details of your booking, including inclusions, session times, and add-ons, will be outlined in your agreement or invoice.
2. Booking and Payment
2.1. Booking Confirmation: Your booking is confirmed upon receipt of a signed agreement and payment of a non-refundable deposit.
2.2. Deposit Policy: Deposits are non-refundable.
2.3. Balance Payment: The remaining balance is due according to the session type, as outlined in your agreement/invoice.
2.4. Payment Plans: Payment plans are available, but no images will be delivered until the payment plan is completed.
2.5. Cancellations and Rescheduling:
Standard Shoots: At least 24 hours' notice is required for cancellations or rescheduling.
Weddings: At least 3 months' notice is required for cancellations or rescheduling.
Deposits are non-refundable regardless of the notice period.
3. Session Details
3.1. Late Arrivals: Late arrivals will be accommodated within the originally agreed session time. Extra time will not be added.
3.2. No-Shows: No-shows will forfeit their non-refundable deposit. To book another session, a new deposit will be required.
3.3. Location Permits: Clients are responsible for obtaining any necessary permits for location shoots.
3.4. Client Cooperation: Full cooperation during the session is essential to achieve the best results.
4. Image Delivery
4.1. Delivery Method: Images will be delivered via an online gallery. Clients are responsible for downloading their images before the gallery is deleted.
4.2. Turnaround Time: Edited images will be delivered within 6–8 weeks from the session date.
4.3. Revisions: Clients may request revisions. Additional charges may apply, depending on the scope of the edits.
5. Image Rights
5.1. Copyright: All images remain the intellectual property of Saywell Photography and are protected under copyright law.
5.2. Client Usage: Upon full payment, clients receive a non-exclusive license to use the images for personal purposes only. Commercial usage rights can be purchased.
5.3. Portfolio Use: We may use client images for marketing, portfolio, and promotional purposes.
6. Refunds and Liability
6.1. Refund Policy: We do not offer refunds for any reason.
6.2. Results: Results are subjective and may vary. We do not guarantee specific outcomes.
6.3. Force Majeure: We are not liable for delays or cancellations due to circumstances beyond our control, such as natural disasters, illness, or equipment failure.
6.4. Limitation of Liability: Our liability for any claim arising from our services is limited to the amount paid to us. We are not responsible for indirect or consequential damages.
7. Privacy
7.1. We collect personal information solely to provide our services and communicate with clients.
7.2. Your information will be handled in accordance with our Privacy Policy.
8. Amendments and Governing Law
8.1. We may update these Terms at any time by publishing them on our website. The version in effect at the time of booking will apply.
8.2. These Terms are governed by the laws of New Zealand. Any disputes will be resolved under New Zealand jurisdiction.
